Overview

One of the great opportunities in this age of “Century of Knowledge” is the emergence of knowledge based IT industries and another emerging opportunities on the horizon is Biotechnology. Biotechnology has the potential to transform the lives of the people in the state by impacting hugely on agriculture, animal husbandry, health, environment protection and material transformation. It is to realize this potential that the state has already announced Biotechnology Policy-2001.

Strategic Initiatives:
  • For effective implementation of this policy, the Maharashtra Biotechnology Board has been constituted under the Chairmanship of Hon’ble Chief Minister
  • Dr. Raghunath Mashelkar, a renowned scientist has been appointed as Chairman of Maharashtra Biotechnology Commission
  • Accordingly budget provision has been made for ₹ 9.83 Crore in the financial year 2007-08
  • The state will emphasize the importance it attaches to Biotechnology by observing State Biotechnology Day on 14th November, the birth anniversary of Late Jawaharlal Nehru

Objectives

The main objectives of Bio-Technology Policy are as follows:

  • Provide to the farmers to the State better, high-yielding, drought and pest-resistant crops suited to the agro-climatic conditions of the State
  • Help to develop affordable and more cost-effective drugs and devices to counter diseases common to India and to tropical and sub-tropical areas, and to reduce the disease burden
  • Develop cheaper and effective technologies to purify water sources and to deal with Industrial effluents and urban wastes, etc.
  • Improve the livestock in the State in order to increase the earning capacity in rural areas.
  • Improve the marine stock to improve the productivity of the fishing industry
  • Enhance the value and utility of medicinal plants and traditional systems of medicine by developing new products with global potential
  • Develop and promote utilization of animal diagnostics and vaccines for preventing losses and increasing realization from livestock and poultry
  • Augment feed and fodder availability and processing
  • Improve the overall nutritional security in the State
  • Improve the quality of life through better health and better environment

Eligibity and Terms & Conditions

Eligibility of the Applicant
  1. Organizations establishing the private B.T. Park can be Registered proprietorship/ Partnership Firm/ Private Limited Company/ Public Limited Company/Co-operative Society or Trust.
  2. The Institute legally responsible for management of the Park, Promoter or Developer of the Park will be eligible for making Application for complying with the prescribed Criteria, Terms & Conditions for the B.T. Park.

1. Land/ Built up Area
  1. For setting up of B.T. Park, minimum 2 acres of land or minimum BUA of 20,000 sq.ft. for B.T. Park Industries and for complimentary services to be provided to them, will be essential.
  2. BT Park will have to fulfilled above area criteria (minimum 2 acres of land or minimum BUA of 20,000 sq.ft.) on basic FSI without considering additional FSI/TDR/Free of FSI.
2. Utilization/Use of built up Area Use of minimum 90% of the total built up area for B.T. industries and maximum 10% built up area (excluding car parking) for incidental and support service facilities will be mandatory.
3. Arrangement for supply of Electricity and Capacity Considering the demand of units established in BT Park a sub-station for electric supply will be set up inside the B.T. Park. Regarding this developer of BT Park has to take Undertaking/ Sanction Order from MSEDCL/ Reliance Energy / Tata Power. It is necessary to provide supply to the B.T promoter through Dedicated Distribution Feeder from the nearest source of the Electricity Distribution Company providing power to the sub-station.
4. Arrangement for Stand By Supply It will be mandatory for the promoter to make arrangement for stand-by generation to the extent of minimum of 30% of the total power requirement determined in SN 3 above.
5. Connectivity
  1. If the satellite earth station is available for the B.T. Park, no limit on capacity of connectivity is applicable. Otherwise it will be essential to provide minimum OFC connection of 5 mbps capacity.
  2. It is not necessary to establish an exchange inside the Park for providing double connectivity. However, there should be arrangement in the Park to provide Last Mile Connectivity and Gateway for International Connectivity.
6. Parking Capacity It is necessary to provide parking space inside the park for one vehicle per 100 sq.mt. of the total built up area of the B.T. Park.
7. Pollution Control - Air, Water & Solid Waste Management Developer has to take pre approval from Maharashtra Pollution Control Board (MPCB) / Environment Department & Local Authority regarding pollution control management.
8. Water Demand Developer has to provide sufficient water as per the requirement of Units / Industries in BT Park. For sufficient water supply developer has to take certificate from Local Authorities regarding availability of water.
9. Common Facilities Developer has to establish permanent system regarding sterilization of Air, Water & Solid Waste and prevention from insects.

Incentives

Directorate of Industries provides following incentives under Biotechnology Policy:

  • Twice the admissible Floor Space Index would be admissible for Biotechnology units in parks promoted by public bodies
  • Biotechnology units will be provided power at industrial tariff. The agriculture biotechnology units would be provided power at agriculture tariff. In addition to this all Biotechnology units would be exempted from statutory power cuts
  • Public bodies or their joint venture will be permitted to establish independent Power Producers’ for the dedicated provision of power to Biotechnology Parks promoted by them
  • Units engaged in agricultural Biotechnology ventures will be designated as agricultural industries with extension of all the incentives, exemption and benefits accruing to that industry. Further, MIDC will allot land to such industrial units in areas under its jurisdiction at industrial rates
Other Incentives:
  • For conducting research and development, the Biotechnology units would be permitted to acquire agriculture land beyond the limit mention under MTAL Act
  • For the benefit of Biotechnology units, the detailed data of public health organization would be made available to Biotechnology units
  • The FDA will play facilitating role in the growth and development of pharmaceutical and food processing Biotechnology industry
  • Related to Urban waste and Industry effluents the Municipal Bodies and Organization with existing infrastructure and data with this undertaking will be made available to Biotechnology Companies for experiment and trials
  • The Biotechnology units within the purview of the shops and establishment act restrictions on shift working would be relaxed, at par with Information Technology Units
  • Special infrastructure has been provided at public Biotechnology park set up at Pune and Jalna
  • As per GR dated 10.2.2009 the Private BT Parks are allowed in Green Zone / No Development Zone / Commercial Zone and Private BT Parks are eligible to get 100% Additional FSI subject to conditions mentioned in the GR
  • For regulation of production and processes related to biotechnology, Ministry of Science & Technology Biotechnology Department, Government of India has proposed to establish a National Bio-technology Regulatory Authority (NBRA) and State Biotechnology Advisory Committee (SBACs) at State level

What is the definition of Biotechnology enterprise / unit?

'Bio-Technology (BT) Unit' means a unit engaged in Research and Development and/or manufacture of products which use or are derived by using (a) living systems, (b) enzymes, (c) Bio-catalysts derived therefrom, in any of the following fields:

What is the eligibility criteria for BT Park?

The BT Park should have minimum land area of 2 acres or 20000 Sq.ft. of Built Up Area (BUA).

What is the procedure for getting LOI /Registration as BT unit?
  1. For getting LOI as BT unit
  2. One has to apply in prescribed application form along with following documents to Competent Authority

    1. Affidavit (Annexure-V)
    2. Certificate from designated Certifying Agency (Annexure -VI)
    3. Locational clearance from DI/JDI,MMR/MIDC/Local Authority, as the case may be.

  4. Those which have started their BT activities / production should apply for BT Registration with the following documents to Competent Authority.

    1. Application for Registration in the prescribed form (Annexure-IV)
    2. Affidavit (Annexure-V)
    3. Locational clearance from Directorate of Industries / MIDC Local/ Authority as the case may be
    4. C.A's certificate regarding turnover of Bio-Tech products / activities exceeding 75% of total turnover (Annexure-VII)
    5. BT Letter of Intent (if obtained)
    6. Certificate from designated Certifying Agency (Annexure-VIII) for existing BT unit
What is the procedure for getting LOI /Registration as BT Park?

For getting LOI/ Registration as BT Park, one has to apply in prescribed application form along with following documents to Competent Authority.

Who is Competent Authority to grant LOI / Registration to BT unit / BT park?

For Greater Mumbai, the Competent Authority is Joint Director of Industries, Mumbai Metropolitan Region and for rest of the Districts, the Competent Authority is General Manager, District Industries Centre of respective District.

For BT Parks located within Mumbai Metropolitan Region, the Competent Authority is Development Commissioner (Inds.), Directorate of Industries, Mumbai. For BT Parks located outside Mumbai Metropolitan Region, the Competent Authority is the General Manager, District Industries Centre of respective District.

What are the Benefits of obtaining LOI / Registration as BT unit?

Once the BT unit gets LOI / Registration, it is entitled to get various incentives such as Industrial Promotion subsidy, Stamp duty exemption and Electricity duty exemption, etc. under Package Scheme of Incentives.

What are the Benefits of obtaining LOI / Registration as BT Park?

Once the BT Park gets LOI / Registration, it is entitled to get double floor space index from respective Planning Authority, upon payment of 25% premium of the present day market value of the land under reference as indicated in the Ready Reckoner.

Is there any fees to be paid to Competent Authority while applying for getting LOI / Registration as BT unit/BT Park? If yes, under which head, the fees is to be paid and where?

For granting LOI / Registration as BT unit, no fees is charged. However, for getting LOI / Registration as BT park, the applicant has to pay ₹ 5000/- as processing fees in the prescribed challan to RBI under following head :

Whether the BT unit is also entitled to get Double Floor Space Index (FSI)?

Yes, provided the existing BT unit / units outside park should have minimum land area of 2 acres or 20000 Sq.ft. of Built Up Area (BUA).

What is the percentage of Builtup area allowed for BT purpose and support services in a BT Park?

Out of total Builtup area of BT park, minimum 90% should be used for Biotechnology purpose and maximum 10% can be used for support services such as Cafeteria, Small Club House and Conference and Video Conferencing Hall.
